Additional Advocate General MC Chaturvedi and Additional Chief Permanent Advocate Ramanand Pandey argued on behalf of the government. They say that the single bench of the High Court has ordered the retired employees to pay with an increase dues from 2015 to 2024. Which is contrary to the intention of the Supreme Court. Due to which a large number of petitions of old years are being filed, while only the benefits of the order should be given to those who have retired after the date filed in the Supreme Court's decision. The original order is from 11 April 2023. On which the government applied a review. While deciding, the Supreme Court made it clear that only the employees after the date of the verdict will get the benefit of the decision. The Supreme Court has fixed the cut -off date of May 1, 2023, so not all the petitioners have the right to gain increase by the order of the single bench.
Satiish Chandra Singh and 10 others, retired opposition petitioners of the Police Home Guard Department, said that the government orders are effective from the date of issuance, but the court orders have a surprise impact, so they also have the right to benefit the court order. The High Court, after listening to both sides, said that the cut -off date of the Supreme Court will be effective. Before that retired employees will not get the benefit of the decision.
