Bulldozers run on 150 year old dargah, Supreme Court sought reply from Uttarakhand government

Dehradun/New Delhi: The Supreme Court on Tuesday summoned the state officials on a contempt petition in the case of demolishing a registered Waqf property in Uttarakhand. The petition alleged that a dargah in Dehradun was demolished without any notice at midnight of 25-26 April, despite the assurance given by the Center on 17 April in the case of challenging the Waqf (Amendment) Act, 2025.

The apex court’s order of April 17 states that any Waqf, including Waqf, will not be notified nor any change in its character or situation, even if it has been declared through notification or through registration. The contempt petition came before the bench of Justice BR Gavai and Justice Augustine George Christ.

Senior advocate Kapil Sibal, appearing for the petitioner, said that the religious site was registered as Waqf property in 1982 and was demolished despite the statement made by the Center before the apex court. Justice Gawai said, “We will keep it for hearing with those cases (related to Waqf (Amendment) Act, 2025).”

Next hearing on 15 May

The bench issued a notice to the officials of Uttarakhand to respond to the petition and the hearing was fixed on 15 May. The apex court will hear the petition challenging the Waqf (Amendment) Act, 2025 on 15 May. The contempt petition filed through advocate Phujail Ahmed Ayubi stated that Dargah Hazrat Kamal Shah was registered as Waqf Property in 1982 with Sunni Central Board of Waqfs, Lucknow.

‘Dargah was made on the Waqf Property’

The petition stated that it is a prestigious site of religious importance for more than 150 years and an undisputed Waqf property. The petition alleged that the action of the state officials is a direct violation of the order of April 17, in which the statement made by Solicitor General Tushar Mehta was recorded. Mehta appeared on behalf of the Center in the matter related to Waqf (Amendment) Act, 2025.

The petition requested contempt action against the officials concerned for allegedly disregarding the affidavit filed in the order of 17 April passed by the apex court.
