The state government should have given EWS quota, it is not possible now … UP 69000 Teachers’ High Court’s big decision in recruitment

Prayagraj: The Allahabad High Court of Uttar Pradesh has rejected the petition filed in the recruitment of 69,000 Assistant Teachers to give reservation to the economic backward classes. In the decision given on Monday, the court admitted that EWS quota had been implemented at the time of recruitment and the government should have given its benefit. However, the High Court said that the recruitment has been completed. The selected candidates have been appointed and have not been challenged. In such a situation, it cannot be ordered to implement EWS quota.

Shivam Pandey and others had filed petitions in front of the bench of Justice Ashwani Kumar Mishra of Allahabad High Court and Justice Praveen Kumar Giri. The petition said that EWS Kota came into force on 12 January 2019 in the country. The state government implemented it in 2020. However, earlier the state government had issued a memorandum on 18 February 2019 and announced the implementation of EWS quota.

Appointment process started in 2020

The petitioners said in the High Court that the appointment process of 69000 assistant teachers started on 17 May 2020. Therefore, it should be benefited. The High Court bench considered EWS Kota applicable from 18 February 2019 and did not accept the vote of single bench that the reservation act would be considered effective from the date of implementation.

Also, the High Court said that while applying, no candidate had mentioned his EWS quota. In such a situation, it is now difficult to decide who will fall in this category. After this, the High Court dismissed the petition.
